A day after appointing a committee to write the Declaration of Independence, the Second Continental Congress appointed another committee to write the Articles of Confederation. Members served from June 1776 to November 1777, when they sent a draft to the states for ratification. On December 16, 1777, Virginia became the first state to ratify the Articles of Confederation. It was Maryland’s last, holding out until March 1, 1781.

The Articles of Confederation represent an attempt to strike a balance between the sovereignty of states and the sovereignty of an effective national government. Under the articles, the states, not Congress, had the power to levy taxes. Congress can raise money only by asking for money from states, borrowing from foreign governments and selling Western lands. Additionally, Congress was unable to formulate forces or control commerce. There was no ruling on national courts or CEOs.

Importantly, the Articles did not actually establish a republican government. Instead of being divided into separate houses and branches like state governments, power was concentrated in a single assembly. Furthermore, the members of the Confederation Congress were elected by the state governments and not by the people.

More than a treaty – or “firm league of friendship” – than a constitution, the Articles of Confederation in no way violate the sovereignty of the original thirteen states. Each state held “its sovereignty, liberty and independence, and every power, jurisdiction and authority, not expressly granted to the United States of America by this union, assembled in Congress.” Congress, the primary organ of the new national government, had only the power to declare war, appoint military officers, sign treaties, form alliances, appoint foreign ambassadors, and manage relations with American Indians. All states were equally represented in Congress, and nine of the thirteen states had to ratify a bill before it could become law. The amendments required the approval of all the states.

Article 1.

Each State shall retain its sovereignty, liberty, and independence, and every power, jurisdiction, and right not expressly delegated by this Union to the United States, shall be assembled in Congress.

Article 3.

The said states hereby enter unilaterally into a strong bond of friendship with one another, for the common defense, and to secure their liberties, and their mutual and common good, and bind themselves to the assistance of one another, against all force offered upon, or attacks made upon them or any of them on account of religion or sovereignty or commerce or any other argument whatsoever.

Article 4.

Better to secure and perpetuate mutual friendship and relations among the people of the various States in this union, the free inhabitants of each of these States, the poor, the vagrants, and those fugitives from justice shall be entitled except for all free privileges and immunities. citizens of several states; The people of each State shall be free to enter and withdraw from and to any other State, and shall enjoy therein all the privileges of trade and commerce, subject to the same duties, assumptions and restrictions which are subject to its residents respectively, provided that the restrictions shall not extend to the extent of preventing the transfer of imported property to any State. , to any other country, the owner of which is a resident of it; Provided that no state, duties, or restrictions may be imposed on or any property of the United States.

If any person guilty of, or accused of, treason, felony or other misdemeanour in any State, shall flee from justice, and be found in any of the United States, he shall, at the request of the Governor or the Executive in the state from which he escaped, deliver him And transfer him to the state that has jurisdiction over his crime.

Full confidence and trust in each of these states shall be given to the records, acts, and judicial proceedings of the courts and justices of the peace in every other state.

Article 5.

For the more appropriate administration of the general interests of the United States, delegates are appointed annually in such manner as the Legislature of each State may direct, to meet in Congress on the first Monday of November, every year, with power reserved to each State to summon its delegates, or any of them, at any time during the year, and send others in their place, for the remainder of the year. . . .

When matters in the United States are decided in Congress in session, each state shall have one vote.

Freedom of speech and debate in Congress shall not be questioned or questioned in any court or place outside Congress, and members of Congress shall be protected in their own persons from arrest or imprisonment, during the time of their going to and from, and in their presence.
