Places Of Worship Act 1991 PDF – Significance

• The Act was passed in September 1991, a year before the demolition of the Babri Masjid (1992).
• Purpose:
  • Section 3 of the Act prohibits the conversion of a place of worship or a part thereof into a place of worship of any other religious denomination or other denomination.
  • The Act imposes an affirmative obligation on the State to maintain the religious nature of every place of worship that existed at the time of independence.
    • This statutory obligation on the state to protect and protect the equality of all religions is an essential secular feature and one of the basic features of the Indian Constitution.
• Exemption:
  • The disputed site in Ayodhya has been exempted from the Act. Barring this exception, the hearing of the Ayodhya case continued even after the passage of this law.
  • The Act does not apply to any monument and the archaeological site or archaeological site which is an ancient and historical monument or archaeological site, or to a place of worship under the 1958 Act.
• Penalties: Section 6 of the Act provides for a fine for contravention of the provisions of the Act with imprisonment of either description for a term which may extend to three years.
